1.                Outfall Drain at the beach at Fifth Avenue:  FDOT developed an approach to channel the initial water from SR-A1A west under SR-A1A with the excess water going through the existing beach structure.  Funding in the amount of $205,000 is included in the FY-04 FDOT Tentative Work Program as conveyed at the October 23, 2001, public hearing and confirmed on August 13, 2002.

2.                New Library:  The grand opening for the Melbourne Beach Public Library is scheduled for October 5, 2002, with a parade at 9:30 a.m. and the ribbon cutting at 11:30 a.m.

3.                FRDAP Grant/Riverside Park:  Project includes a 400 foot pier, a covered area approximately 30 feet by 30 feet at the western terminus of the pier, lighting, 2 handicapped parking spaces, 3 new benches, and a small walkway.  The new park and FRDAP funding signs have been installed.  Pier lighting has been installed.  This completes the grant work improvements at this park.

4.                FRDAP Grant/Douglas Park:  The application for FRDAP funds in the amount of $50,000 was submitted to FDEP on October 5, 2001.  The project improvements include two handicap parking spaces, connecting walkways, a gazebo, and sea wall improvements.  State Senator Futch and State Representative Needelman presented the ceremonial check for $50,000 to the Mayor and council members on July 16, 2002.  The Town is waiting to receive the project agreement that will need Council action.

5.                Prescott Ward Lawsuit:  The court has found in favor of the Town concerning Dr. Ward’s lawsuit against the Town.  The cost to defend the Town was $3,276.  The Town was notified that Dr. Ward filed an appeal with the District Court of Appeals; however, it has been denied.

 

6.                Union Agreement:  The present agreement with the Coastal Florida PBA that covers police officers and communications officers expires September 30, 2002.  Negotiations were held on August 2, 2002.  The results of the negotiations have been provided to the Town’s labor attorney to review for proper wording.  It will then be forwarded to the PBA for membership ratification and then to the Council for action.

 

7.                Cathy Spafford started July 29, 2002, as the Town’s Building Official.

 

8.                County sewer line installation: A force main has been installed from the N. Riverside Drive/Second Avenue intersection along Second Avenue to Palm Avenue and south on Palm Avenue through the Town.  The County requested to install this line to eliminate the sewage overflow situation that has occurred in the past at the intersection of Miami Avenue and S. Riverside Drive.  The County awarded the bid and issued the Notice to Proceed effective 8/22/01. The County has temporarily discontinued replacing the lift station portion of the contract.  It will be addressed over the next six months.  The County has been made aware that the contractor installed swales with steeper slopes along S. Palm Avenue at Palm Court and Tenth Terrace than existed prior to construction.  The County is working to correct this matter.

 

9.                Fifth Avenue Right Turn Lane at Riverside Drive and Left Turn Lane at SR-A1A: The bid to construct the improvements, including an eight-foot bicycle path through Douglas Park, was awarded on October 16, 2001, to the low bidder—i.e. Watson Paving, Inc. in the amount of $152,183.75.  Construction of the left turn lane extension on Fifth Avenue at SR-A1A and of the right turn lane on Fifth Avenue at S. Riverside Drive is complete.  FDOT is determining if they want to have a railing installed between the sidewalk and curb on the south side of US-192.  Additionally, the remaining funds contained in the Joint Participation Agreement (JPA) are being reviewed by FDOT to determine if they exist in sufficient quantity to allow for the installation of mast arms at US-192 and Riverside Drive.

 

10.            Brevard County Shore Protection Project—South Reach:  Sand has been applied along the area’s coastline.  It was installed to south of access #8 with the taper running just south of access #1.  In November it is expected that the crew will return to widen the area where the taper begins, i.e. south of access #8 and continue the improvement to Flug Avenue.  Great Lakes Dredge & Dock, the contractor, expects to continue to utilize the state property south of Wavecrest Avenue as their staging area.  The County has installed a diffuser for the outfall structure at Tampa Avenue.

 

11.              Sunrise Park Addition:  County staff members have expressed a willingness to lease the property to the Town for park use.  Town staff has forwarded comments regarding the draft inter-local agreement that was provided by the County and awaits the County’s response.  The County has been short personnel in the Parks Department resulting in certain projects being delayed.  Staffing is back up and the Town has been promised a more rapid review of the agreement comments.

 

12.              Street Resurfacing:  Staff has replaced failing curb sections on those streets that have been approved by the Council for resurfacing and has replaced storm drainpipes.  Patching should be completed shortly with the resurfacing of the 200 and 300 blocks of 9th Terrace, 200 and 300 blocks of 12th Terrace, and Palm Avenue from 2nd Avenue to Watson Avenue beginning around September 9, 2002.

 

13.             Notice:  The glass enclosed bulletin board situated in the Indialantic Shopping Center by the grocery store that had previously been utilized for official notices has been relocated to a location that has more foot traffic—i.e. between the Dollar General Store and Beach Street Eatery.  The bulletin board is being used by Town staff to post official notices as a secondary site in addition to Town Hall.
