MINUTES OF A TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON MAY 15, 2007

 

      PRESENT:

Hon. Robert L Cochran, Jr., Mayor

Hon. Vince Benevente, Deputy Mayor

Hon. Bruce Bogert, Councilman

Hon. Loren Goldfarb, Councilman

Paul Gougelman, Town Attorney

Christopher W. Chinault, Town Manager

Laura Eaton, Town Clerk

 

           ABSENT: 

Hon. Dave Berkman, Councilman

     I.     CALL TO ORDER AT 7:00 PM

 

Mayor Cochran called the meeting to order at 7:00 PM.

 

    II. PLEDGE OF ALLEGIANCE

 

  III. PUBLIC

 

A.     Proclamations – Eastminster Church and Heritage Committee

 

Mayor Cochran read and presented proclamations to representatives from the Eastminster Presbyterian Church and the Heritage Committee.

 

Denise Bozeman, Chairman of the Heritage Committee, also thanked the Eastminster Church and presented a donation in appreciation.

 

             B.     Lois Schissel, 440 10th Ave., brought up an on-going code violation on her street and the Town Manager reported that the problem is being addressed by Code Enforcement.

 

  IV. PUBLIC ANNOUNCEMENTS

 

A.     There are currently openings on the Board of Adjustment, Budget and Finance Committee, Civil Service Board, Zoning and Planning Board, General Employees’ Pension Board, Police/Fire Pension Board and Parks, Recreation and Beautification Committee

 

             B.     There will be openings on the Budget and Finance Committee, Civil Service Board, and Code Enforcement Board in May

 

             C.     Town Hall will be closed Monday, May 28, 2007 for Memorial Day

 

   V.     CONSENT AGENDA

 

A.     Minutes No. 07-07– Regular Meeting – April 17, 2007

 

B.     Approval of Amendment #1 to the Mowing and Landscape Maintenance Agreement concerning Sunrise Park

 

C.     Approval of allocation of Edward C. Byrne Memorial Justice Assistance grant funds to the Brevard County Sheriff’s Department for prisoner transportation/booking improvements

 

      Deputy Mayor Benevente moved to approve the Consent Agenda.  Councilman Goldfarb seconded.

 

      Councilman Bogert requested that Item C be removed for discussion.

 

      Motion to approve Consent Agenda Items A & B carried unanimously.

 

      The Town Manager clarified how the grant in Item C works.

 

      Councilman Bogert moved to approve Item C.  Deputy Mayor Benevente seconded.  Motion carried unanimously.

 

  VI.     APPOINTMENTS

 

             A.     Board of Adjustment - 1 opening.  Jack Kish would like to be reappointed

 

                  Councilman Bogert moved to reappoint Jack Kish.  Deputy Mayor Benevente seconded.  Motion carried unanimously.

 

             B.     Civil Service Board – 2 openings.  Marlene Waclawski would like to be reappointed

 

                  Councilman Goldfarb moved to reappoint Ms. Waclawski.  Deputy Mayor Benevente seconded.  Motion carried unanimously.

 

             C.     Parks, Recreation and Beautification Committee – Marge Schwanbeck would like to be reappointed

 

                  Deputy Mayor Benevente moved to reappoint Ms. Schwanbeck.  Councilman Bogert seconded.  Motion carried unanimously.

                  

D.     General Employees’ Pension Board – 1 opening.  Loredana Kalaghchy would like to be reappointed

 

                  Councilman Bogert moved to reappoint Ms. Kalaghchy.  Deputy Mayor Benevente seconded.  Motion carried unanimously.

                  

             E.     Police/Fire Pension Board – 1 opening.  Mike Casey would like to be reappointed

 

                  Councilman Goldfarb moved to reappoint Mike Casey.  Councilman Bogert seconded.  Motion carried unanimously.

 

             F.     Zoning and Planning Board – 1 opening.  Dan Sullivan would like to be reappointed

 

                  Deputy Mayor Benevente moved to reappoint Dan Sullivan.  Councilman Bogert seconded.  Motion carried unanimously.

 

VII.     ORDINANCES AND RESOLUTIONS

 

             A.     Ordinance 07-07 – Adding a new Sec. 5-7 prohibiting fires in or on any park structure

 

1.    Second reading – by title only

           

            The Town Clerk read the Ordinance by title only.

 

                   2.     Public hearing and adoption on second reading

 

                   Deputy Mayor Benevente moved to approve Ordinance 07-07.  Councilman Bogert seconded.

 

                   There were no public comments.

 

                   Motion carried unanimously.

                  

             B.     Ordinance 07-08 – Amending Sec. 5-80 and 5-84 relating to sea turtle preservation

 

1.    Second reading – by title only

 

            The Town Clerk read the Ordinance by title only.

 

2.    Public hearing and adoption on second reading

 

                   Councilman Bogert moved to approve Ordinance 07-08.  Deputy Mayor Benevente seconded.

 

                   There were no public comments.

 

                   Motion carried unanimously.

 

             C.     Ordinance 07-09 – Amending Sec. 2-123 – Mayor’s compensation

 

1.    Second reading – by title only

 

            The Town Clerk read the Ordinance by title only.

 

2.    Public hearing and adoption on second reading

 

                   Deputy Mayor Benevente moved to approve Ordinance 07-09.  Councilman Bogert seconded.

 

                   There were no public comments.

 

                   Motion carried unanimously.

 

             D.     Ordinance 07-10 – Amending Sec. 13-53 – Melbourne Causeway

 

1.    First reading – by title only

 

            The Town Clerk read the Ordinance by title only.

 

2.    Public hearing and adoption on first reading

 

                   Councilman Bogert moved to approve Ordinance 07-010. Councilman Goldfarb seconded.

 

                   There were no public comments.

 

                   The Town Manager provided background.

 

                   Motion carried unanimously.

 

             E.     Ordinance 07-11 – Establishing a Deferred Retirement Option Plan (DROP) for the Police/Fire Pension Fund

 

1.    First reading – by title only

 

            The Town Clerk read the Ordinance by title only.

 

2.    Public hearing and adoption on first reading

 

Councilman Goldfarb moved to approve Ordinance 07-11.  Councilman Bogert seconded.

 

                   There were no public comments.

 

                   Motion carried unanimously.

     

 

 

 

VIII.UNFINISHED BUSINESS

 

             A.     Discussion and possible action regarding a committee to improve Fifth Avenue (continued from the March 20, 2007 meeting)

 

                  Councilman Goldfarb reported that he had met with the Town Manager who had drafted an outline for a Fifth Avenue Task Force setting goals and with an ending time frame.

 

                  The Town Manager clarified that the charter prohibits non-resident business owners from being members of the committee and that extent of the task force would reach beyond the scope of the Parks, Recreation Beautification Committee.

 

                  Councilman Goldfarb moved to approve the task force outline.  Councilman Bogert seconded. 

 

                  John B MacNeill, 1320 S Riverside Dr., supported the effort and encouraged participation from non-resident business owners.

 

                  Motion carried unanimously.

B.     The  Town Attorney had no report.

A.     Mayor Cochran reported that the Police Department had hired two new officers.

 

B.      Deputy Mayor Benevente had no report.

 

C.     Councilman Bogert had no report.

 

E.     Councilman Goldfarb had no report.
