MINUTES OF A TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON APRIL 17, 2007

 

      PRESENT:

Hon. Robert L Cochran, Jr., Mayor

Hon. Vince Benevente, Deputy Mayor

Hon. Dave Berkman, Councilman

Hon. Bruce Bogert, Councilman

Hon. Loren Goldfarb, Councilman

Paul Gougelman, Town Attorney

Christopher W. Chinault, Town Manager

Laura Eaton, Town Clerk

     I.     CALL TO ORDER AT 7:00 PM

 

Mayor Cochran called the meeting to order at 7:00 PM.

 

    II. PLEDGE OF ALLEGIANCE

 

  III. PUBLIC

 

Karen Turja, 303 Melbourne Ave., raised several code enforcement issues and received clarification from the Town Manager on the required process.

 

George Gergora, 316 Deland Ave., thanked the Heritage Committee and those who participated in the anniversary celebration for an incredible program.

 

  IV. PUBLIC ANNOUNCEMENTS

 

            The Town Clerk read the following announcements:

 

A.     There are currently openings on the Budget and Finance Committee, Civil Service Board, Code Enforcement Board, Police/Fire Pension Board and Zoning and Planning Board

 

             B.     There will be openings on the Civil Service Board, Budget and Finance Committee, Heritage Committee, Police/Fire Pension Board and Parks, Recreation and Beautification Committee in April

 

   V.     CONSENT AGENDA

 

A.     Minutes No. 07-06– Regular Meeting – March 20, 2007

 

B.     Approval of agreement with the Florida Division of Emergency Management to receive Hazard Mitigation grant funds in the amount of $17,042 to install shutters on Town Hall (local match is $5,681)

 

C.     Proclamation – May  20-26, 2007 - Public Works Week

 

D.     Approval of First Responder Agreement with Brevard County

 

Councilman Bogert moved to approve the Consent Agenda.  Deputy Mayor Benevente seconded.  Motion carried unanimously.

 

 

  VI.     APPOINTMENTS

 

             A.     Budget and Finance Committee - 2 openings.  Eugene Terkoski would like to be reappointed

 

                  Deputy Mayor Benevente moved to reappoint Mr. Terkoski.  Councilman Bogert seconded.  Motion carried unanimously.

 

             B.     Heritage Committee – Carol Andren, Denise Bozeman, Jenifer Marx and William Miller would like to be reappointed.  Application received from Irene Quilleux

 

                  Deputy Mayor Benevente moved to reappoint Ms. Andren, Ms. Bozeman, Ms. Marx and Mr. Miller and to appoint Ms. Quilleux.  Councilman Berkman seconded.  Motion carried unanimously.

 

             C.     Parks, Recreation and Beautification Committee – Betty Preece would like to be reappointed

 

                  Deputy Mayor Benevente moved to reappoint Ms. Preece.  Councilman Bogert seconded.  Motion carried unanimously.

 

The Mayor amended the agenda to discuss Item VIII at this time.

 

VIII. UNFINISHED BUSINESS

 

A.     Discussion and possible action regarding improving communication with Town residents (continued from the March 20, 2007 meeting)

 

Councilman Berkman gave background.

 

Loren Strand, 120 Ormond Ave., demonstrated an e-mail system prototype designed to provide information to those Town residents electing to sign up for the program.

 

Attorney Gougelman advised that a statutory disclaimer should be added and a that a licensing agreement should be drawn up.

 

The following members of the public received further clarification on the program:

 

            Helen Yarborough, 325 Oakland

            George Gergora

            Laura Lewandowski, 125 8th Ave

 

Councilman Goldfarb moved to try the system for six months and re-evaluate at the end of that period.  Councilman Berkman seconded.  Motion carried unanimously.

 

VII. ORDINANCES AND RESOLUTIONS

 

             A.     Ordinance 07-07 – Adding a new Sec. 5-7 prohibiting fires in or on any park structure

 

1.    First reading – by title only

 

The Town Clerk read the ordinance by title only.

 

2.    Public hearing and adoption on first reading

 

Deputy Mayor Benevente moved to approve Ordinance 07-07.  Councilman Goldfarb seconded.

 

The Town Manager gave background.

 

There were no public comments.

 

Motion to approve Ordinance 07-07 carried unanimously.

 

             B.     Ordinance 07-08 – Amending Sec. 5. relating to sea turtle preservation

 

1.    First reading – by title only

 

The Town Clerk read the ordinance by title only.

 

2.    Public hearing and adoption on first reading

 

Councilman Goldfarb moved to approve Ordinance 07-08.  Deputy Mayor Benevente seconded.

 

There were no public comments.

 

Council requested clarification on sections (i)(2) and (3) for the next meeting.

 

Motion to approve Ordinance 07-08 carried unanimously.

 

             C.     Ordinance 07-09 – Amending Sec. 2-123 – Mayor’s compensation

 

1.    First reading – by title only

 

The Town Clerk read the ordinance by title only.

 

                   2.     Public hearing and adoption on first reading

     

                   The Town Manager gave background explaining that the code provision concerning compensation for the Mayor had been overlooked when Council salaries were increased in November.

 

                   Deputy Mayor Benevente moved to approve Ordinance 07-09.  Councilman Bogert seconded. 

 

                   There were no public comments.

 

                  Motion to approve Ordinance 07-09 carried unanimously.

 

  IX.      NEW BUSINESS

 

             A.Discussion and possible action regarding Central Florida Regional Growth Vision 

            

                  The Town Manager gave background on the issue raised through the Space Coast League of Cities.

 

                  Mr. Chinault recommended taking no action at this time and the Council agreed by consensus.

                  

   X.     ADMINISTRATIVE MATTERS

 

A.     Report from Town Manager

Statistical Reports – March, 2007

 

        Mr. Chinault noted that the large piece of play equipment in Nance Park was closed due to rust and that it was covered by warranty.

 

B.     The Town Attorney had no report.

The entire Council thanked and congratulated the Heritage Committee and everyone else who participated in the anniversary program for a very fine job.

 

Deputy Mayor Benevente recommended a proclamation be issued to Eastminster Presbyterian Church for their contributions.

 

Deputy Mayor Benevente also reported on Legislative Action Day and announced that we will be co-hosting the Space Coast League of Cities meeting May 14 with Melbourne Beach and urged all to attend.

 

XII. ADJOURNMENT
