MINUTES OF A REGULAR TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON MARCH 16, 2004.

 

PRESENT:        Hon. Vince Benevente, Deputy Mayor

                         Hon. Bruce Bogert, Councilman

                         Hon. Mike McCabe, Councilman

                         Paul Gougelman, Town Attorney

                         Christopher W. Chinault, Town Manager

                         Laura Eaton, Town Clerk

 

ABSENT:          Hon. Daniel S. Trott, Mayor (Excused)

                          Hon. Cliff Cook, Councilman (Excused)

     I.     CALL TO ORDER AT 7:00 PM

 

Deputy Mayor Benevente called the meeting to order at 7:00 PM.

 

    II.     PLEDGE OF ALLEGIANCE

 

  III.     PUBLIC

            

John B. MacNeill, 1320 S. Riverside Dr., read the paragraph cut from his letter to the editor published in Florida Today and submitted the entire letter into the record.

 

  IV.      PUBLIC ANNOUNCEMENTS

 

            The Town Clerk read the following announcements:

 

A.   There are currently openings on the Board of Adjustment, the Zoning and Planning Board and the Budget and Finance Committee

 

B.   There will be openings on the Parks, Recreation, Beautification Committee and the Heritage Committee in April

 

C.   The annual Easter Egg Hunt will be held on Saturday, April 3, 2004 in Orlando Park beginning at 9:00 am

 

D.   The Code Enforcement Board will hold a workshop on Wednesday, April 7, 2004 at 7:00 pm

 

   V.     CONSENT AGENDA

 

A.   Minutes No. 04-05 – Regular Meeting – February 17, 2004

 

B.   Authorization for the Brevard Mosquito Control District to operate an aircraft over the Town to spray for mosquitoes

 

C.   Approval to change craft show dates from July 17 & 18 to July 24 & 25

 

D.   Resolution 04-03 – Authorizing the Town Manager to submit a grant application to the U.S. Department of Homeland Security for a generator, personal protective equipment, radios and a thermal imaging camera for the Fire Department and committing to the required matching funds

 

Councilman Bogert moved to approve Consent Agenda Items A & B.  Councilman McCabe seconded.  Motion carried unanimously.

 

Deputy Mayor Benevente received clarification from the Town Manager on the fees received from the craft show.

 

Deputy Mayor Benevente moved to approve Item C.  Councilman Bogert seconded.  Motion carried unanimously.

 

Councilman Bogert received clarification on the source of the $10,000 matching funds in Resolution 04-03.

 

Councilman Bogert moved to adopt Resolution 04-03.  Councilman McCabe seconded.  Motion carried unanimously.

 

  VI.     APPOINTMENTS

 

A.   Board of Adjustment – Two openings.  Applications received from Phil Gaarder and Mike Melhado

 

      Councilman McCabe moved to appoint Mike Melhado.  Councilman Bogert seconded.  Mr. Melhado was appointed unanimously.

 

      Councilman McCabe moved to table any other appointment until the next meeting.  Councilman Bogert seconded.  Motion carried unanimously.

 

B.   Zoning and Planning Board – One opening.  Randy Greer would like to be reappointed 

 

      Councilman Bogert moved to reappoint Randy Greer.  Deputy Mayor Benevente seconded.  Mr. Greer was reappointed unanimously.

 

VII.     ORDINANCES AND RESOLUTIONS

 

A.   Ordinance 04-07 – Creating a new section 17-116 regulating temporary portable storage units

 

1.      Second reading – by title only

 

The Town Clerk read to ordinance by title only.

 

      2.  Public hearing and adoption

 

      Councilman Bogert moved to approve Ordinance 04-07.  Deputy Mayor Benevente seconded.

 

      The Town Manager clarified for Councilman Bogert how the sizes were determined.

 

      There was no public comment.

 

      Motion to approve Ordinance 04-07 carried unanimously.

 

B.   Ordinance 04-08 – Amending Sec. 17-106(5)(b) – Permits waived for certain temporary and transient signs unless specifically required

 

      1.  First reading – by title only

           

            The Town Clerk read the ordinance by title only.

 

 

 

 

      2.  Public hearing and adoption on first reading

 

      Councilman Bogert moved to approve Ordinance 04-08.  Deputy Mayor Benevente seconded.

 

      The Town Manager gave background on the ordinance noting that this code section should be amended to be consistent with recent changes to the transient sign code.

 

      There was no public comment.

 

      Motion to approve Ordinance 04-08 carried unanimously.

 

VIII.     UNFINISHED BUSINESS

 

A.   Discussion and possible action regarding Council goals and objectives for 2004

 

Councilman Bogert moved to table this item to the next meeting.  Councilman McCabe seconded.  Motion carried unanimously.

 

  IX.     NEW BUSINESS

 

   X.     ADMINISTRATIVE MATTERS

 

A.   Report from Town Manager

Statistical Reports – February 2004

     

      The Town Manager also reported on the sand decompaction work to be done on the beach.

 

B.   Report from Town Attorney

 

Attorney Gougelman had no report.

 

  XI.     REPORTS

 

A.   Councilman McCabe announced his neighborhood meeting on April 18 at 2:00 PM at Tampa Ave and the Water Board meeting on March 19.

 

B.      Councilman Bogert  had no report.

 

C.     Deputy Mayor Benevente announced the League of Cities meeting April 12 and Legislative Day on April 14.  He also announced that Indialantic and Melbourne Beach would be hosting the League dinner on May 10.

 

             The Town Manager thanked the Council for their help and support for the annual Appreciation Dinner and recognized John B. MacNeill as the Citizen of the Year.

 

XII.            ADJOURNMENT
