MINUTES OF A REGULAR TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON MARCH 18, 2003.

                PRESENT:

                        Hon. Daniel S. Trott, Mayor

I.       CALL TO ORDER AT 7:00 PM

 Mayor Trott called the meeting to order at 7:10 PM.

 II.       PLEDGE OF ALLEGIANCE

 III.      PUBLIC

Ken Turja, 303 Melbourne Ave., questioned the installation of a stop sign on S. Palm Ave.  The Town Manager stated that this is clarified in the Manager’s Report and is a response to a safety hazard.

 George Gergora, 316 Deland Ave., expressed thanks for the Board of Adjustment workshop presented by Attorney Gougelman.

 Karen Turja, 303 Melbourne Ave., suggested a painted crosswalk or sign for pedestrian traffic at the boardwalk across from Bizarro’s.

 Teresa Dyer, 135 8th Ave., recommended that Council follow through with a previously discussed workshop concerning traffic issues.

 IV.     PUBLIC ANNOUNCEMENTS

           The Town Clerk read the following announcements:

 A.        The Parks/Recreation/Beautification Committee is accepting applications for new members

 B.        Members are needed for the Heritage Committee

 C.        The Easter Egg Hunt will be held on Saturday, April 12, 2003 in Orlando Park beginning at 9:00 am

 D.        There will be openings on the Budget and Finance Committee, Civil Service Board and Code Enforcement Board in May

V.      CONSENT AGENDA

 A.       Minutes No. 03-05 – Regular Meeting – February 18, 2003

 B.        Approval of lifeguard agreement with Brevard County

 C.       Approval of mid year budget adjustments for FY 02/03

1.      General Fund budget

2.      Enterprise 1 and 2 budgets

 D.       Resolution 03-05 – Supporting efforts by the Melbourne International Airport to secure grant funds from the Federal Small Community Air Service Development Program through the U.S. Department of Transportation

 E.        Approval of the Disbursement Agreement with Brevard County for TIFT monies in the amount of $18,313 for the Second – Third Avenue sidewalk connector

 Deputy Mayor Bogert moved to approve the Consent Agenda.  Councilman Benevente seconded. Motion carried unanimously.

VI.      APPOINTMENTS

 A.     Board of Adjustment – One opening. George Gergora would like to be reappointed.

 Councilman Benevente moved to reappoint Mr. Gergora.  Deputy Mayor Bogert seconded.

Motion carried unanimously.

 B.     General Employees’ Pension Board – One opening.  Applications received from Nancee Hay and Robin Petersen

 Deputy Mayor Bogert moved to appoint Mr. Petersen.  Councilman Benevente seconded.  Motion carried unanimously.

 C.     Zoning and Planning Board – One opening.  Randy Greer would like to be reappointed

 Deputy Mayor Bogert  moved to reappoint Mr. Greer.  Councilman McCabe seconded.  Motion carried unanimously.

 D.     Parks/Recreation/Beautification – Virginia McLaughlin would like to be reappointed

 Councilman Benevente moved to reappoint Ms. McLaughlin.  Deputy Mayor Bogert seconded.  Motion carried unanimously.

VII.         ORDINANCES AND RESOLUTIONS

 A.   Ordinance 03-03 – Amending Section 17-30 and 17-31 to provide for the Brevard County School Board to appoint a non-voting member to the Zoning and Planning Board/Local Planning Agency

1.   Second reading – by title only

 The Town Clerk read the ordinance by title only.

2.   Public hearing and adoption

Councilman McCabe moved to approve Ordinance 03-03.  Councilman Cook seconded. 

There were no public comments.

Motion carried unanimously.

B.Ordinance 03-04 – Amending Sections 6-30(c)(1) and 11-9 - Deleting provisions to appeal variance decisions to the Board of Adjustment consistent with Ordinance 03-01

1.   Second reading – by title only

  The Town Clerk read the ordinance by title only.

2.   Public hearing and adoption

Councilman Benevente moved to approve Ordinance 03-04.  Councilman Cook seconded.

There were no public comments.

Motion carried with Deputy Mayor Bogert, Councilman Benevente, Councilman Cook and Councilman McCabe voting “yes.”  Mayor Trott voted “no.”

C.   Ordinance 03-05 – Amending Sections 17-88 and 17-127(16) – Clarifying the definition of “breezeway” requirements in the “T” Tourist District

1.   Second reading – by title only

  The Town Clerk read the ordinance by title only.

2.   Public hearing and adoption

Councilman Cook moved to approve Ordinance 03-05.  Councilman Benevente seconded.

There were no public comments.

Motion carried unanimously.

 D.Ordinance 03-06 – Adding a new Section 17-106.4(11) to allow and regulate beautification recognition signs

1.   Second reading – by title only

  The Town Clerk read the ordinance by title only.

2.   Public hearing and adoption

Deputy Mayor Bogert moved to approve Ordinance 03-06.  Councilman Benevente seconded. 

There were no public comments.

Motion carried unanimously.

 VIII.       UNFINISHED BUSINESS

 IX.      NEW BUSINESS

 A.Discussion and possible action regarding adding architectural design standards for new construction in the “T” Tourist District – requested by Councilman McCabe

 Councilman McCabe moved to discuss amending Code Sec. 17-127 to include architectural design standards in the T district as they exist in the C and C-1 districts.  Councilman Cook seconded.

 Mayor Trott questioned how this would affect single family residences in those districts.

 The following members of the public spoke:

George Gergora, 316 Deland Avenue

Councilman McCabe explained that the intent is to ensure that characteristics associated with particular architectural styles are better clarified.

The Town Manager recommended having pictures available in the building department to guide builders in their choice of features.

Councilman McCabe moved to request that   the Parks/Recreation/Beautification Committee draft recommendations as to the desired architectural style in the T district and better define standards in the C and C-1 districts and forward them to the Zoning and Planning Board for consideration.  Councilman Cook seconded.  Motion to proceed carried unanimously.

 X.    ADMINISTRATIVE MATTERS

 A.     Report from Town Manager

Statistical Reports – February 2003

 Town Manager Chinault clarified that finals details for the beach renourishment program are forthcomingHe also pointed out that the County had put in plants between access #8 and crossover #15 to help with dune stabilization.

 B.        Report from Town Attorney

                 No report.

 XI.    REPORTS

 A.        Mayor Trott had no report.

 B.         Deputy Mayor Bogert had no report.

 C.        Councilman Benevente reported on the League summit meeting, noting that Councilman Cook is the Town’s representative.  With Council’s support, Councilman Benevente volunteered to serve as the alternate. Councilman Benevente also encouraged the Council to attend the May League of Cities meeting co-hosted by Melbourne Beach and Indialantic and that Trash Bash Day will be April 19th.

 D.        Councilman Cook requested that the Council address a citizen advisory board for traffic issues at the April meeting.  He also reported that an unlicensed elder care home in Town would be investigated by the state’s attorney’s office.

 Councilman Cook stated that he had received a call concerning bus parking at the beach.  Town Manager Chinault reported that oversized vehicle spaces had been poured this date for parking in Nance Park.

 Councilman Cook also reported that a property owner who had been denied a variance for parking a RV in the side yard is still parking there.

E.         Councilman McCabe thanked the Town employees for a fine job and the DAR for the tree planting in Orlando Park.  Councilman McCabe advised that the Brevard Water Board would meet 3/25/03. He also questioned whether the Town regulated advertising at bus stops and whether there was a schedule for painting fire hydrants.  Councilman McCabe announced that his next neighborhood meeting would be at Nance Park.

 

Peter Heaton received clarification on Ordinance 03-04.
