CONSIDERATION OF REQUEST FOR EXTENSION
CEB No. 00-01
BonaDent Dental Lab
321 Sixth Avenue
Indialantic, Fl. 32903
Code Section 17- 107 –
Manufacturing prohibited
Code Section 17-125(1)(i) -
Non-permitted use (manufacturing)
Atty. Gougelman
swore in Andrea Bonafiglia who requested that June 29, 2001 be considered as
the last day of business. Ms. Bonafiglia had requested this date by letter at
the April 11, 2001 Code Board meeting. BonaDent was given to May 28, 2001 to
cease manufacturing with a fine of $100.00 per day being imposed
starting May 29, 2001. BonaDent Dental Lab has been sold with a closing date of
June 29, 2001. Construction delays of the new location have made impossible the
May 28, 2001 date for ceasing manufacturing at the Sixth Avenue address.
Atty. Gougelman
swore in Mike Fischer, the contractor for the new BonaDent building in West
Melbourne. Mr. Fischer advised the Board that unforeseen delays have prevented
Ms. Bonafiglia from meeting the May 28, 2001 deadline for stopping
manufacturing. Mr. Fischer also stated that he is 99% sure that the building
will have a certificate of occupancy in one to two weeks and would appreciate
the support of the Board.
Atty. Novak
gave the Board a brief history of this case and informed the Board that the
staff has no problem with the requested extension of June 29, 2001.
Atty. Gougelman
swore in Mr. Golen, of 324 Seventh Avenue. Mr. Golen lives behind BonaDent Labs
and stated that he has no problem with the 30-day extension.
The Chairman
closed the hearing for discussion by the Board.
After
discussion, Mr. Brillante moved to approve the extension to June 29, 2001 and
that the previously imposed fine date be moved to June 30, 2001. Ms. Preece
seconded. Motion passed unanimously.
Atty. Gougleman requested that certified copies of all Orders be recorded
immediately.
