1. CALL TO ORDER AT 5:30 PM
Vice Chairman Lewandowski called the meeting to order at 5:30 PM.
2. OATH OF OFFICE TO NEW MEMBERS
A. Mary Coggshall
B. David A. Justice
Attorney Gougelman administered the Oath of Office to Mary Coggshall and David A Justice.
3. APPROVAL OF PRIOR MEETING MINUTES
A. Minutes No. 07-02, February 1, 2007
Mr. Dullaghan moved to approve Minutes No. 07-02. Ms. Coggshall seconded. Motion carried unanimously.
4. APPEAL
A. An appeal filed by Trevor Nimmons, D.O., 210 Michigan Ave., to the Building Official’s decision to decline a home occupational license application for an osteopathic office.
Dr. Nimmons explained that he previously submitted an application for a home occupational license without knowledge of the zoning codes which prohibited seeing patients at his residence.
Dr. Nimmons stated that he subsequently reapplied intending to use his home for administrative purposes only.
In answer to questions from Attorney Gougelman, Dr. Nimmons clarified that he would not see patients in his home, that he would not sell any merchandise from his residence and that no medical supplies would be stored there.
(At this point Mr. Kish arrived.)
Building Official Cliff Stokes stated his concerns with the intent of the original application and pointed out that there was no way to enforce any violation of the license.
After further discussion, Mr. Kish moved to grant the appeal to the home occupational license application dated December 8, 2006 stipulating that the applicant agrees to on-site inspections once a year unless the Town is acting on a Code Enforcement complaint. Mr. Dullaghan seconded. Motion carried unanimously.
5. ADJOURNMENT
The meeting was adjourned at 6:00 PM.
