BOARD OF ADJUSTMENT MEETING

1. CALL TO ORDER AT 5:30 PM
Chairman Evans called the meeting to order at 5:30 PM.
2. APPROVAL OF PRIOR MEETING MINUTES
A. Minutes No. 06-05– June 15, 2006
Mr. Wright moved to approve Minutes No. 06-05. Ms. Lewandowski seconded. Motion carried unanimously.
3. VARIANCE REQUEST
A. A variance request filed by David DeMitchell regarding Lot 12, Blk 37, 2 Wavecrest Ave. A variance is being requested to Code Section 17-132(11)(h) – a fence surrounding an outdoor café area shall be set back no less than three (3) feet from the boundary line of the property. The effect of the variance, if granted, would be to allow the fence surrounding the outdoor café area to be erected less than 3 feet from the property line.
Dave DeMitchell, 150 Deland Ave., explained he was requesting the variance to provide enough room for outdoor seating and to keep his property consistent with the neighboring businesses.
The Town Manager clarified that the fence would be 6” from the property line requiring a variance of 2’6”. He pointed out the Mr. DeMitchell is improving the condition of the property and providing better drainage.
Mr. Chinault also advised that Mr. DeMitchell is working with an existing building which limits his options.
Ms. Lewandowski moved to Mr. DeMitchell’s request for a variance of 2’ 6” for the outdoor café fencing. Mr. Dullaghan seconded. Motion carried unanimously.
B. A variance request filed by Ben Weissberg regarding Lots 14 & 15, Blk 43, 604 S Ramona Ave. A variance is being requested to Code Section 17-121(6) – front yards shall not be less than twenty-five (25) feet in depth. The effect of the variance, if granted, would be to allow a 14’ 9” setback in the front yard to provide for a garage addition.
Ben Weissberg, 604 S Ramona Ave., explained his plan to convert his existing one car garage into a bedroom and add a two-car garage at the front of the house. He indicated that he has a practical difficulty in that the garage cannot be located elsewhere on his property.
Mr. Weissberg added that he would be bringing the property up to Code requiring a two-car garage.
Mr. Chinault pointed out that the addition would not infringe on the neighboring properties or protrude into the right-of-way.
The Board discussed the hardship and alternatives available to Mr. Weissberg
Attorney Gougelman advised that a practical difficulty could provide the basis for granting a variance.
Ms. Lewandowski moved to deny the request for a variance. Mr. Evans seconded. Motion carried unanimously.
4. ADJOURNMENT
The meeting was adjourned at 6:05 PM.
