Code Complaint Process

1.   Code complaint should be sent to codeenforcement@indialantic.com (if by e-mail); Code Enforcement, Town of Indialantic, 216 Fifth Avenue, Indialantic, FL  32903 (if by mail); (321) 723-2242 if by telephone; or (321) 984-3867 ATTN:  Code Enforcement (if by fax machine).

 2.   Once complaint received to be logged in, acknowledgement sent to person filing the complaint, and the complaint forwarded to the Building Official/Code Enforcement Officer for action with copy to the Town Manager to monitor and/or address.

Short-Term (i.e. Vacation) Rental related complaints

1.   Complaint to be sent and processed as noted above.

2.   Process for action is as follows:

a.   If pictures are provided with the complaint they need to have the date and time that the pictures were taken as well as the person’s name and address who took the pictures.  It is desired that whoever takes the pictures be willing to appear at a future Code Board meeting, should this complaint reach the Code Board, to authenticate the information.  Pictures of cars in front of a residence should reflect the vehicle in proximity to the residence.

b.  Staff will visit the site and take pictures, if not provided, or in addition to those provided.

c.  Staff will approach the residence and advise the occupant as to the short-term rental regulations in the Town and inquire about whether the occupants are renting for a short period of time (i.e. less than 90 days).  Approaching the residence will occur during normal business hours.

(1)  Staff will request a copy of any lease that the occupant has in his/her possession reflecting the length of time for which the residence is being rented.

(2)  Staff will note if the occupant indicates he/she has rented the residence for a period of time shorter than the 90 day period and from whom he/she rented the residence.

d.   Staff will independently check the internet, local newspapers, and any available publications that might verify that a residence is being rented for periods of time less than 90 days.

e.   Staff will forward a warning citing the violation if one appears to exist.  The owner will have 10 days in which to comply.  Staff will indicate that the owner should call the Code Officer when the violation has been remedied.  The owner will be requested to supply the town with a copy of any lease(s) that he/she has indicating that the length of time for the rental of the residence is at least 90 days.  Note:  If the owner fails to contact the Code Officer and resolve the matter or if the problem appears to continue a Statement of Violation will be sent putting the matter before the Code Enforcement Board.
