RESOLUTION 07-02

 

A RESOLUTION OF THE TOWN OF INDIALANTIC, BREVARD COUNTY, FLORIDA RELATING TO SECTION 6-11, TOWN CODE, AMENDING FEES FOR VARIANCE APPLICATIONS, PROVIDING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE

 

            WHEREAS, the Town Council has determined that it is in the public interest to set user fees so that the individuals who utilize certain municipal services shall pay directly for that service; and

 

            WHEREAS, the costs associated with processing variance applications continue to increase; and

 

            WHEREAS, the Town Council determines that this is a matter of an administrative nature which will promote the public health, safety, welfare, economic order and aesthetics of the community,

 

            NOW, THEREFORE, be it resolved by the Town Council of the Town of Indialantic, Brevard County, Florida, as follows:

 

            SECTION 1.  That Resolution 05-08 is hereby amended as follows:

 

SECTION 1.  PERMITS/APPLICATION FEES SET.  The Town of Indialantic shall charge the following rates for the following types of permits:

8)            Zoning and Planning:  the following fees and charges in connection with matters pertinent to Comprehensive Plan amendment requests, zoning petitions, variances and appeals are established:

                        c)  Application for a variance to the Board of Adjustment, $155.00. $225.00

 

SECTION 2.  Severability/Interpretation Clause.

 

(a)   In the event that any term, provision, clause, sentence or section of this Ordinance shall be held by a court of competent jurisdiction to be partially or wholly unenforceable or invalid for any reason whatsoever, any such invalidity, illegality, or unenforceability shall not affect any of the other or remaining terms, provisions, clauses, sentences, or sections of this Resolution, and this Resolution shall be read and/or applied as if the invalid, illegal, or unenforceable term, provision, clause, sentence, or section did not exist.

 

SECTION 3.  Effective Date.  This Resolution shall become effective upon its adoption by the Town Council.
