RESOLUTION NO. 06-05

 

A RESOLUTION OF THE TOWN OF INDIALANTIC, BREVARD COUNTY, FLORIDA, EXPRESSING OPPOSITION TO THE PROPOSED “SAVE BREVARD” AMENDMENT TO ARTICLE 9 OF THE BREVARD COUNTY CHARTER RELATING TO VOLUNTARY ANNEXATION; MAKING FINDINGS; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR ADOPTION.

 

 

 

            WHEREAS, Save Brevard, a Political Action Committee, is proposing an amendment to Article 9 of the Brevard County Charter relating to voluntary annexation; and

            WHEREAS, if approved by the voters, the amendment would provide an exclusive method for voluntary municipal annexation within Brevard County; and

            WHEREAS, Chapter 171, Florida Statutes, sets forth uniform standards and procedures for adjusting the boundaries of municipalities through annexation or contraction of corporate limits within the State of Florida; and

            WHEREAS, the methods and procedures for annexations set forth in Chapter 171, Florida Statutes, have lengthy legislative history and body of case law to guide municipalities and property owners in moving forward through the annexation process; and

            WHEREAS, Section 171.044, Florida Statutes, “Voluntary Annexation,” provides a streamlined process for the annexation of property whereupon the consent of one hundred percent of the owners of real property of an unincorporated area of a county which is contiguous to a municipality and reasonably compact may be annexed to the municipality with the consent of the municipality; and

            WHEREAS, if approved by voters, the proposed exclusive method for voluntary annexation within Brevard County would impair the rights of thousands of property owners to simply petition for annexation and develop properties within municipalities to obtain higher level of municipal services;

 

 

 

      NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF INDIALANTIC, BREVARD COUNTY, FLORIDA to oppose the proposed Save Brevard Charter amendment to Article 9 of the Brevard County Charter and request that the Board of County Commissioners table the proposal and refer it to the Growth Management Task Force for further review and consideration.
