MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON JULY 8, 2015

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 pm.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 15-06, May 13, 2015

Vice Chairman Justice moved to approve the minutes. Mr. Dullaghan seconded. Motion carried unanimously.

3. VARIANCE APPLICATION

A. A variance request filed by Warren Rinderknecht regarding Part of Lot 18, Blk. 70, 1306 Magnolia Drive, Indialantic, Florida 32903. A variance is being requested to Code Section 17-121(7)(b)-Side Yards. The applicant is requesting a variance of 5 feet 3 inches from Miami Avenue to front porch, resulting in a 19 foot 9 inch setback for porch.

Warren Rinderknecht, owner of 1306 Magnolia Drive, Indialantic, Florida 32903, submitted 13 photos to the Board. Mr. Rinderknecht told the Board that he would like to build a porch or patio on the Southeast side of his home.

William Fitzgerald, owner of 1304 Magnolia Drive, Indialantic, Florida 32903, told the Board that the Rinderknecht’s have improved the home greatly and he approved of the variance.

After some discussion, Vice Chairman Justice moved to approve the variance based on a practical difficulty being that of the existing setback of the structure and irregular shape of the lot. The variance is for the installation of the size and location as shown on the survey prepared by Kane Surveying. The variance shall expire if the home is razed or the Southeastern wall is removed. Mr. Kalaghchy seconded. Motion carried with Chairman Wright, Vice Chairman Justice, Mr. Kalaghchy voting yea and Mr. Dullaghan voting nay.

B. A variance request filed by Sean and Heidi Tate regarding Lots 13 and 14, Blk. 60, 300 N. Shannon Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-121(7)(b)-Side Yards and Code Section 17-122(6)-Front Yards. The applicants are requesting a 2 foot variance resulting in an 8 foot setback for the side yard and a 15 foot 10 inch variance resulting in a 9 foot 2 inch setback for the front yard.

Sean Tate, owner of 300 N. Shannon Avenue, Indialantic, FL 32903, told the Board that the home he purchased was built in the 1950’s or early 1960’s. Mr. Tate said the garage they currently have is a one car garage and is not large enough to put their vehicle. Mr. Tate said he doesn’t believe the new garage would obstruct anyone’s view.

Attorney Gougelman brought to the Board’s attention that there was a mistake in the ad for the variance. The ad lists Code Section 17-121(7)(b) but it should be Code Section 17-122(7)(b).

After some discussion, the Board suggested to Mr. Tate to come back with plans showing a smaller structure.

Attorney Gougelman asked the applicant if he would be willing to withdraw his application and resubmit a new application.

Mr. Tate agreed to withdraw the application.
