MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON MAY 13, 2015

  1. CALL TO ORDER AT 5:30 PM

 

Chairman Wright called the meeting to order at 5:30 pm.

 

  • APPROVAL OF PRIOR MEETING MINUTES

 

 

  1. Minutes 15-05, April 8, 2015

 

Vice Chairman Justice moved to approve the minutes.  Mr. Kalaghchy seconded.  Motion carried unanimously.

 

Attorney Gougelman introduced Attorney Anthony Soroka to the Board.  Attorney Soroka works at the same firm as Attorney Gougelman.

 

  1. VARIANCE APPLICATION

 

  1. A variance request filed by Sean and Heidi Tate regarding Lots 13 and 14, Blk. 60, 300 N. Shannon Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-122(6)-Front Yards and 17-121(7)(a)(b)-Side Yards. The applicants are requesting a variance for an 18 foot setback in the front and a 4 foot setback on the side for a garage.

 

Building Official Cliff Stokes passed out six photos of the Tate’s property to the Board.

 

Sean Tate, owner of 300 N. Shannon Avenue, Indialantic, FL 32903, told the Board that the home he purchased in 2008 was built in the 1950’s and the garage is not large enough to put their vehicle in and there is no room for storage.  He said the practical difficulty is that the garage is too low for their SUV to fit and they have no storage space.

 

Heidi Tate, owner of 300 N. Shannon Avenue, Indialantic, FL 32903, told the Board that they are not sure what size the new garage would be because they wanted to see if the variance would be approved first but they did want it to be a two story garage

 

Attorney Gougelman asked the applicants if they would be willing to withdraw their application and resubmit a new application since the Board and Building official were unaware that they were asking for a two story garage.

 

Mr. Justice moved to waive the application fee for the Tate’s when they resubmit the application.  Mr. Kalaghchy seconded.   Motion carried unanimously.

 

The Tate’s agreed to withdraw the application.

 

  1. A variance request filed by Kempf Inc. regarding Lots 21, 22 and 23, Blk. 14, 336 Fifth Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-106.4(6)(b)1-Signs authorized in the various zoning districts. The applicant is requesting a variance to allow an additional sign on the east face of their building.

 

Jason Kempf, owner of 336 Fifth Avenue, Indialantic, FL 32903, stated that Kempf’s has been         a Rolex dealer for eight years. He said that having another sign on the east side of the building would make it known to drive by traffic that they are an official Rolex jeweler and increase their business.  Mr. Kempf agreed to a 10 square feet condition for the size of the sign.

 

After discussion, the Board decided there is a practical difficulty.  Mr. Justice moved to approve the variance request for a sign on the true front entry of the building with the condition of the sign being no more then 10 square feet.  Mr. Dullaghan seconded.  Motion carried unanimously.
