MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON APRIL 8, 2015

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 pm.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 15-04, February 11, 2015

Mr. Dullaghan moved to approve the minutes. Mr. Evans seconded. Motion carried unanimously.

3. VARIANCE APPLICATION

A. A variance request filed by David and Nelsy Ool, regarding Lots 11, and 12, Blk. 54, 301 Michigan Avenue, Indialantic, Florida 32903. A variance is being requested for Code Section 17-122(7)(a) – Side Yard Setbacks. The applicants are requesting a variance for the second floor along eastern property line resulting in a 9.6 foot setback at the north end to a 9.5 at the south end.

Building Official Stokes noted that the requested variance is for the western property line, not the eastern.

Nelsy Ool, owner of 301 Michigan Ave., advised that they are constructing a second story to be used as a bedroom and office. She advised that they received a variance in 2009 for the first floor and are now requesting the same variance for the second floor in order for the exterior wall to be consistent.

Attorney Gougelman read page 2 of the previous variance which noted that the existing property was non-conforming in that the home intruded 10 inches into the required setback based on a surveying error.

Dale Saunders, 310 First Ave., stated that he lives behind the Ools and is in favor of the variance.

After discussion Mr. Justice moved to approve the variance of .8 feet, approximately 10 inches, based on practical difficulty. The variance will allow a side yard setback of 9.2 feet from the lot line of Lot 10, Block 54. Mr. Evans seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting adjourned at 5:50 pm.
