MINUTES OF A TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON OCTOBER 21, 2014

PRESENT: Hon. Dave Berkman, Mayor
Hon. Loren Goldfarb, Deputy Mayor
Hon. Dick Dunn, Councilmember
Hon. Stuart Glass, Councilmember
Paul Gougelman, Town Attorney
Christopher W. Chinault, Town Manager

ABSENT: Hon. Randy Greer, Councilmember (Excused)

I. CALL TO ORDER AT 7:00 PM

Mayor Berkman called the meeting to order at 7:00 pm.

II. PLEDGE OF ALLEGIANCE

III. PUBLIC

Larry Michelson, 113 Tradewinds Terrace, and Joyce Everitt, 114 Tradewinds Terrace, requested that the Town look into drainage issues on that street.

Jill Hoffman, 125 Michigan, requested clarification on a recent incident involving the Town killing a neighbor’s vine growing on a speed limit sign in the Town right-of-way. It was requested that residents be notified in the future of any similar issues prior to the Town taking action.

IV. PUBLIC ANNOUNCEMENTS

The Town Clerk read the following announcements:

A. There are currently openings, including reappointments, on the Civil Service Board, General Employees Pension Board and the Parks, Recreation and Beautification Committee

B. There will be openings, including reappointments, on the Code Enforcement Board, General Employees Pension Board and the Parks, Recreation and Beautification Committee in October

C. Incumbents David Berkman, Mayor, and Stu Glass, Council Seat 4, are unopposed in the November 4, 2014 election. Jill Hoffman, candidate for Council Seat 2, is also unopposed

D. Town Hall will be closed Tuesday, November 11, 2014 for Veterans Day

V. CONSENT AGENDA

A. Minutes No. 14-14 – Regular Meeting – September 16, 2014

B. Appointments
1. Melbourne Beach Library Board – Elfriede Raedler and Thomas Carnohan would like to be reappointed. Reappoint Ms. Raedler and Mr. Carnohan
2. General Employees’ Pension Board – 1 opening. Application received from Lorraine Schulte. Appoint Ms. Schulte

C. Acceptance of the Town Manager’s evaluation

D. Ratification of the Coastal Florida Police Benevolent Association Agreement

Councilmember Glass moved to approve items A, B and C. Councilmember Dunn seconded. Motion carried unanimously.

D. Ratification of the Coastal Florida Police Benevolent Association Agreement

Councilmember Glass stated that he feels the provision to require the Town to pay incentives to dispatchers who receive a Bachelor or Associate degree should only apply to job related degrees.

Council discussed the issue and noted that any change to the agreement at this point would require further negotiation with the union.

Mayor Berkman moved to approve item D. Deputy Mayor Goldfarb seconded. Motion carried with Councilmember Glass voting “nay.”

VI. ORDINANCES AND RESOLUTIONS

A. Ordinance 15-01 – Amending Sec. 2-103 relating to the Town Council meeting date

1. First reading – by title only

Attorney Gougelman read the ordinance by title only.

2. Public hearing and adoption on first reading

Mayor Berkman noted that the ordinance is being proposed in order to continue using the services of Attorney Gougelman as Town Attorney after he relocates.

There were no public comments.

Mayor Berkman moved to approve the ordinance on first reading. Councilmember Dunn seconded. Motion carried unanimously.

VII. UNFINISHED BUSINESS

A. Discussion and possible action regarding painting Town Hall

Mayor Berkman presented two shades of blue from the Sherwin Williams color sample to be considered for painting Town Hall: Tidewater for the building and Drizzle for the doors and trim.

Councilmember Dunn presented Crisp Linen as his suggestion.

The following members of the public spoke on the color suggestions:

Linda Paige – 1419 S. Riverside
Karen Turja – 303 Melbourne Avenue
Larry Michelson, 113 Tradewinds Terrace
Jenifer Marx – 205 Orlando Blvd.
Pamela Dunn – 330 Tampa Avenue

Council requested that samples of the colors be painted on the building for public comment.

B. Discussion and possible action regarding the General Employees’ Pension Plan

Council requested that staff contact someone from the Florida Retirement System (FRS) to determine how the General Employees’ plan could be integrated and how the FRS plan compares to the Town’s current plan.

Councilmember Glass requested that the Florida Municipal Pension Trust Fund, administered through the Florida League of Cities, also be considered. He suggested the Dominick Montanaro from Satellite Beach attend the November meeting to explain that process.

Council requested that staff survey the other municipalities in the County to determine the type of plan being offered to general employees.

A. Report from Town Manager
Statistical Reports – September, 2014

Town Manager Chinault thanked everyone for their patience with ongoing road construction projects.

B. Report from Town Attorney – Attorney Gougelman had no report.

X. REPORTS

A. Mayor Berkman reported on a recent Mayors’ meeting he attended and advised that Councilmember Glass has been appointed to the Board of Director of Honor Flight.

B. Deputy Mayor Goldfarb advised that the WW5k event was very successful and that he will present a report at the November meeting.

C. Councilmember Dunn received guidance from Attorney Gougelman regarding the Town’s options should Amendment 2 pass at the November 4th election.

D. Councilmember Glass thanked Deputy Mayor Goldfarb for his service on the Council.

E. Councilmember Greer was not present.

XI. ADJOURNMENT

The meeting adjourned at 8:02 pm.
