I. CALL TO ORDER AT 10:30 a.m.

Chairman Kowalski called the meeting to order at 10:30 am.

II. DOCTOR SELECTION FOR THE INDEPENDENT MEDICAL EXAMINATION REGARDING RYAN DESCHENES

A. Attorney Jensen presented the Board with a list of doctors that were contacted regarding Ryan Deschenes’, who was present, independent medical examinations. After some discussion the Board decided on Orthopedic Doctor Jeffrey T. O’Brien and Neurology Doctor Christopher J. Prusinski for the examinations.

Mr. Bogert moved to approve Dr. O’Brien and Dr. Prusinski for Mr. Deschenes independent medical examinations. Chief Flamm seconded. Motion carried unanimously.

III. SCOTT ELLIOTT’S PENSION BENEFIT OFFSET

A. Attorney Jensen advised the Board that they have two questions to answer regarding Scott Elliott, who was present. First, whether both the Temporary Total Disability payment and the Permanent Impairment benefits are to be offset. And second, how to collect any required offset on past lump sum payments.

Mr. Elliott’s attorney Tonya Oliver addressed the Board giving them Mr. Elliott’s procedure history.

After discussion, Sgt. Casey suggested that the Town’s attorney from the Florida League of Cities be requested to define Workers Compensation as written in the Town’s code and possibly be present at the next meeting.

Mr. Bogert moved to hold off any decision regarding Mr. Elliott until the Board hears from the Town’s attorney regarding the definition of Workers Compensation in the Town’s code.

IV. ADJOURNMENT

Mr. Kowalski moved to adjourn at 11:35 am. Sgt. Connor seconded. Motion carried unanimously.
