MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON SEPTEMBER 18, 2014

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 pm.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 14-02, June 12, 2014

Mr. Dullaghan moved to approve the minutes. Mr. Campbell seconded. Motion carried unanimously.

3. VARIANCE APPLICATIONS

A. A variance request filed by B&W Group Services LLC for Luke Graham regarding Lots 1, 21, E ½ of 2, Blk. 94, 105 Orlando Blvd, Indialantic, Florida 32903. A variance is being requested to Code Section 17-86 – setbacks and 17-121(6) – front yard. The applicants are requesting a variance of one foot from Sec. 17-86 resulting in a 49 feet setback and 6 feet from Sec. 17-121(6) resulting in a 19 foot setback to add a front porch.

The following member of the public spoke:

Michael Williams of B&W Group Services and the agent for Luke Graham the home owner of 105 Orlando Blvd., Indialantic, FL 32903. Mr. Williams told the Board the history of the house that was built in 1955. He explained how the house used to be one parcel and years later was split into two parcels.

Attorney Gougelman discussed the history of zoning in the Town. Based on the discussion, it is likely that both the front yard setback requirement and the centerline setback requirements were not adopted until after construction of the applicant’s home.

Based on a practical difficulty, Mr. Campbell moved to approve a variance of a one foot variance from Section 17-86(1)(b) allowing all of the front porch to be built not more than 49 feet from the centerline of Orlando Blvd and a six foot variance from Section 17-121(6) allowing all of the front porch to be built not more than 19 feet from the front property line on Orlando Blvd. Mr. Dullaghan seconded. Motion carried unanimously.

Both variances are granted subjected to two conditions. The front porch cannot be removed from the front of the house or the variance shall terminate. And if the front porch is ever enclosed the variance shall terminate.

4. ADJOURNMENT

The meeting adjourned at 6:05 pm.
