MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON JUNE 12, 2014

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 pm.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 14-01, March 12, 2014
B. Minutes 14-01A April 10, 2014

Mr. Evans moved to approve the minutes. Mr. Campbell seconded. Motion carried unanimously.

3. VARIANCE APPLICATIONS

A. A variance request filed by Chris St. Germain regarding Lots 21 and 22, Blk. 26, 130 Fifth Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 5.5-46 – murals prohibited. The applicants are requesting a variance to repair an existing mural.

The following members of the public spoke:

Chris St. Germain, the property owner of 130 Fifth Avenue, stated he wants to repaint the mural on the east side of his building.

Mike McClusky, 130 Fifth Avenue, is the artist wanting to repaint the mural. Mr. McClusky stated that it is a practical difficulty for him not to repaint the mural. He believes the mural is historical and wants to make it beautiful again for the Town. Mr. McClusky plans to put a wrap film on the windows.

Mayor Dave Berkman, 225 Eighth Avenue, stated that Council did not allow murals because they could not regulate what is on the murals.

Louis Postma, 112 Fourth Avenue, didn’t understand why the applicant had to come in front of the Board to make a repair to his building.

Linda Postma, 112 Fourth Avenue, spoke against the variance. Mrs. Postma handed out photos taken of the existing mural and a photo that was submitted to the Council in the past by Mr. McClusky of a proposed mural.

The Board discussed the wrap film that would be used on the windows to continue the painting of the mural. Town Manager Chinault advised that the windows need to be consistent to the fire codes and would have to be inspected. The Board also discussed that the mural should be the same mural that already exists.

Mr. Campbell moved to approve a variance, based on a practical difficulty, for allowing the mural to be repainted but must meet two conditions. The mural must be substantially the same mural as currently exists and the wrap film must be permitted by the life safety code and the fire protection code. Mr. Evans seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting adjourned at 6:43 pm.
