MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON MARCH 12, 2014

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:40 pm.

2. OATH OF OFFICE

A. Jeffrey Schulte

Chairman Wright swore in Mr. Schulte as a member on the Board of Adjustment.

3. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 13-05 – July 29, 2013

Chairman Wright moved to approve the minutes. Vice Chairman Justice seconded. Motion carried unanimously.

4. VARIANCE APPLICATIONS

A. A variance request filed by James Warburton regarding Lots 11 and 12, Blk. 53, 300 Michigan Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-88(3)(b) – fence setbacks. The applicants are requesting a 10 feet variance to the code requiring that, in the case of a corner lot, the side yard fence be setback a minimum of ten (10) feet from the lot line on the abutting street.

The following members of the public spoke:

James Warburton, the property owner of 300 Michigan Avenue, stated that his fence is falling apart and it would improve his property if the fence were replaced. He would like to replace it with a 4 feet white picket or chain linked fence. He stated that several trees would have to be moved, including an Avocado tree, Hibiscus tree, Date Nut Palm tree and another palm tree. He also mentioned that his sprinklers would have to be adjusted.

Gerry Warburton, also owner of property 300 Michigan Avenue, stated that the fence is rusted and needs replaced. Nothing on the fence works and is more of a hazard than anything else.

David Stuart, 310 Michigan Avenue, stated that he is the Warburton’s next-door neighbor and that the fence is an eye sore.

The Board noted that the trees have been on the property for 25 years and it would be an unnecessary hardship to move them elsewhere. The Board also discussed the type of fence that should be allowed. Type of fences discussed were slated, picket or chain linked and should have open visibility.

A 10 feet variance for allowing a 4 feet high fence with open visibility through the structure of the fence located on the side abutting the street from the front of the structure line to the rear of the property line.

Vice Chairman Justice motioned to approve a 10 feet variance for allowing a 4 feet high fence with open visibility through the structure of the fence located on the side abutting the street from the front of the structure line to the rear of the property line, based on an unnecessary hardship. Mr. Evans seconded. Motion carried unanimously.

5. ADJOURNMENT

The meeting adjourned at 6:10 pm.
