MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON APRIL 10, 2014

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 pm.
This meeting is being redone due to the incorrect lot numbers on the owner’s application. The original meeting was on March 12, 2014.

2. VARIANCE APPLICATIONS

A. A variance request filed by James Warburton regarding Lots 13 and 14, Blk. 53, 300 Michigan Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-88(3)(b) – fence setbacks. The applicants are requesting a 10 feet variance to the code requiring that, in the case of a corner lot, the side yard fence be setback a minimum of ten (10) feet from the lot line on the abutting street.

The following members of the public spoke:

Gerry Warburton, the property owner of 300 Michigan Avenue, stated she would like to replace the fence with a 4 feet white picket or chain linked fence. She stated that it would be a hardship to move several trees and her sprinklers because they are on the fence line.

The Board discussed the type of fence that should be allowed. The type of fences discussed were, picket and chain linked. The fence should have open visibility. They agreed that it would be a hardship for the owners to move their vegetation.

Mr. Dullaghan motioned to approve a 10 feet variance for allowing a 4 feet high fence with open visibility through the structure of the fence located on the side abutting the street from the front of the structure line to the rear of the property line, based on an unnecessary hardship. Mr. Evans seconded. Motion carried unanimously.

3. ADJOURNMENT

The meeting adjourned at 5:43 pm.
