MINUTES OF A TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON APRIL 21, 2014

PRESENT: Hon. Dave Berkman, Mayor
Hon. Loren Goldfarb, Deputy Mayor
Hon. Dick Dunn, Councilmember
Hon. Stuart Glass, Councilmember
Paul Gougelman, Town Attorney
Christopher W. Chinault, Town Manager

I. CALL TO ORDER AT 7:00 PM

Mayor Berkman called the meeting to order at 7:00 pm.

II. PLEDGE OF ALLEGIANCE

There were no public comments.

IV. PUBLIC ANNOUNCEMENTS

The Town Clerk read the following announcements:

A. There are currently openings, including reappointments, on the Heritage Committee and Parks, Recreation and Beautification Committee

B. There will be openings, including reappointments, on the Police/Fire Pension Board, the Zoning and Planning Board and the Parks, Recreation and Beautification Committee in May

V. CONSENT AGENDA

A. Minutes No. 14-07 – Regular Meeting – March 24, 2014

B. Appointments

1. Heritage Committee – 2 openings. Carol Andren and Jenifer Marx would like to be reappointed. Reappoint Ms. Andren and Ms. Marx

C. Approval of park maintenance bid to the lowest bidder

D. Approval of Resolution 14-08 – Budget Adjustment #2 for FY-14

E. Approval of the Interlocal Agreement forming the Space Coast Transportation Planning Organization

Councilmember Dunn moved to approve the consent agenda. Councilmember Glass seconded. Motion carried unanimously.

VI. ORDINANCES AND RESOLUTIONS

A. Ordinance 14-06 – Extending the solid waste franchise agreement with Harris Sanitation

1. Second reading – by title only

Attorney Gougelman read the ordinance by title only.

2. Public hearing and adoption

There were no public comments.

Mayor Berkman moved to adopt Ordinance 14-06. Deputy Mayor Goldfarb seconded. Motion carried unanimously.

B. Ordinance 14-07 – Amending Chapter 18 relating to stormwater runoff and fertilizers

1. Second reading – by title only

Attorney Gougelman read the ordinance by title only.

2. Public hearing and adoption

Clyde Giesenschlag, 5749 Carissa Rd., Melbourne Village, requested that Council make additional minor changes to the ordinance.

Town Manager Chinault recommended that no additional changes be made at this point and that Council can consider those changes at a later date.

Mayor Berkman moved to adopt Ordinance 14-07. Councilmember Glass seconded. Motion carried unanimously.

C. Ordinance 14-08 – Repealing Sec. 3-8 – Females Soliciting Drinks

1. Second reading – by title only

Attorney Gougelman read the ordinance by title only.

2. Public hearing and adoption

Mayor Berkman moved to adopt Ordinance 14-08. Councilmember Dunn seconded. Motion carried unanimously.

VIII. NEW BUSINESS

A. Discussion and possible action regarding restoring the Town Manager’s salary to the pre-September 2009 level

Town Manager Chinault noted that, due to budget concerns, he took a 3% reduction in his salary in 2009 which was offset the first year with eventual compensation of 71 hours of unused sick leave. He requested that his salary now be restored to the previous level.

Councilmember Dunn recommended that payment for the sick leave be spread over two or more years. Town Manager Chinault advised that he will prepare an additional amendment to his contract to provide for payment of half of the 71 hours of sick leave in 2014 and the balance to be paid in 2015.

Mayor Berkman moved to restore the Manager’s salary to the pre-September 2009 level and to pay the sick leave over two years. Councilmember Dunn seconded. Motion carried unanimously.

B. Discussion and possible action regarding a memory bench in Tampa Avenue Park

Town Manager Chinault presented background information on a request to install a memory bench in Tampa Avenue Park noting that the cost would be paid by the person requesting the bench.

Council had no objection to the proposed bench.
