MINUTES OF A CODE ENFORCEMENT BOARD MEETING HELD IN THE INDIALANTIC TOWN HALL ON MARCH 6, 2013

1. CALL TO ORDER AT 6:00 P.M.
Mr. Campbell called the meeting to order at 6:00 p.m.

2. ROLL CALL
The secretary called the roll.

3. APPROVAL OF MINUTES
November 1, 2012; 13-01

Mr. Brillante moved to approve the minutes as written. Mr. Campbell seconded. Motion carried unanimously.

4. OPENING STATEMENT
Mr. Campbell read the opening statement.

5. VIOLATION HEARINGS

A. Case Number 13-002
Physical Addictions, 200 South Miramar Avenue, Indialantic, Florida 32903
Richard D. Martis, 255 Sea Crest Drive, Melbourne Beach, Florida 32951
Town Code Section 17-106.2(2)(a) – Prohibited Signs

Attorney Gougelman swore in Mr. Stokes and Mr. Colombo qualified him as an expert in code enforcement and building inspection.

Attorney Colombo submitted the following into evidence:

Code Violation memo from Town Manager Chinault
Notice of violation (4 pages)
Documentation from Mr. Stokes noting dates and times of violation
Notice of hearing (6 pages)

Mr. Stokes stated he did not have any discussions with Mr. Martis.

Mr. Stokes recommended a fine of $250.00 per day if there is no compliance. Mr. Stokes also noted the property is still in violation as of March 6, 2013.

Attorney Gougelman swore in Mr. Martis.

Mr. Martis noted the trailer sign is legally registered and has a license plate.

Attorney Gougelman swore in Town Manager Chinault.

Mr. Adams moved to find in view of the evidence and/or testimony presented to the board in Case No. 13-002, that the respondent, Physical Addictions and Mr. Rick Martis, be found guilty of a violation of Town Code Section 17-106.2(2)(a) and the respondent be given 24 hours to come into compliance with the Town Code or be fined $250.00 per day the violation continues. Mr. Brillante seconded. Motion carried unanimously.
