MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON MAY 7, 2012

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 12-04, April 11, 2012

Mr. Evans moved to approve Minutes 12-04 as written. Mr. Dullaghan seconded. Motion carried unanimously.

3. VARIANCE APPLICATIONS

A. A rehearing for a variance filed by Amibka Palaniyandi, regarding Lots 9, 10 and 11, Blk. 99, 1325 South Miramar Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 6-30(c) – Building east of the Brevard County Coastal Construction Control Line.

Mr. Stephenson, engineer for the applicant presented the application.

Mr. Bates accepted Mr. Stephenson as an expert witness. Mr. Dullaghan seconded. Motion carried unanimously.

Vice-Chairman Justice moved to re-affirm the May 17, 2011 approval to build 231.97’ east of the coastal construction line as set forth on the plans. Mr. Dullaghan seconded. Motion carried unanimously.

B. A variance is being filed by Bayswater Development Corp., regarding Lots 15, 16, and 17, Blk. 29, 100 Eighth Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section – 17-82(1) and (3) – Lots of record in a residential district; Code Section 17-83 – Reduction of lot area; Code Section 17-124(4) – Lot area; Code Section 17-124(5) – Lot dimensions and Code Section 17-124(7)(a) – Side yards

Dude Braselton, Bayswater Development, presented the application.

The following spoke in opposition of the project:
Lawrence Maxwell

Mr. Evans moved to grant the variance request as presented. Motion failed.

Mr. Dullaghan moved to deny the variance request as presented. Vice-Chairman Justice seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting was adjourned at 6:50 PM.
