MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON AUGUST 29, 2012

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 12-05, May 7, 2012

Vice-Chairman Justice moved to approve Minutes 12-05 as written. Mr. Evans seconded. Motion carried unanimously.

3. VARIANCE APPLICATIONS

A. A variance is being filed by Conan and Lynda Popovich, regarding Lots 21 and 22, Blk. 30, 122 Ninth Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section – 17-105(5) – Swimming Pools – Enclosures and/or decking shall be set back at least four (4) feet from the lot line for interior lots and at least ten (10) feet from the lot line on a corner lot whose side yard abuts a street

Lynda Popovich, 122 Ninth Avenue, Indialantic, Florida presented the application.

Mrs. Popovich noted the pool needed to be resurfaced as it was 23 years old and the lawn was sinking and was creating a safety hazard around the pool deck. Mrs. Popovich noted the fence company said they could lay the pavers to the fence line, and later found out that was a Brevard County Code not a Town of Indialantic Code. To ensure good drainage, Mrs. Popovich noted they installed a new fence and raised it, removed the sprinkler zone in that area, installed super gutters to drain around both sides of the house into their own yard, installed wider deco drains by the pool which drains into the rock bed and dug a trench and installed a pipe for future underground utilities.

Conan Popovich noted the pavers were thin and set on crushed aggregate with sand in between and that there was no mortar or steel involved in the installation.

Mr. Bates moved to approve the variance request to Code Section 17-105(5) to allow a four-foot wide area contiguous to and along the rear property line of the Real Property from the East property line of the Real Property running 53 and ½ feet Westward and a four-foot wide area contiguous to and along the East property line of the Real Property from the rear property line of the Real Property running 50 feet Southward. The variance is granted on the condition that the pavers covering this area are removable pavers that have been handset and that do not use metal reinforcement or mortar (with the exception of the pool deck perimeter border tiles which may use mortar but not metal reinforcement). Vice-Chairman Justice seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting was adjourned at 6:15 PM.
