MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON FEBRUARY 27, 2012

1. CALL TO ORDER AT 5:30 PM

Vice-Chairman Justice called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 12-01, January 23, 2012

Mr. Dullaghan moved to approve Minutes 12-01 as written. Mr. Bates seconded. Motion carried unanimously.

3. VARIANCE APPLICATIONS

A. A variance is being filed by Salvatore Collura on behalf of Diane A. Konicel and Kathryn R. Habada, regarding Lot 1 Blk. 13, a vacant lot located at the corner of Third Avenue and Ramona Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 17-122(7)(b) – Request to reduce yard from twenty-five (25) feet to twenty (20) feet on side abutting street.

Salvatore Collura, 110 Warsteiner Way, Melbourne Beach, Florida, presented a variance request for a five (5) foot setback to have a twenty (20) foot setback from the abutting side street instead of the required twenty-five (25) foot setback.

The following residence spoke in opposition of the variance request:
Lillian Shiro, 336 Third Avenue
John Brumbaugh, 333 Third Avenue
Regina Schmidt, 325 Third Avenue
Tammy, Le Quear, 339 Third Avenue

Mr. Collura noted there have been other requests for variances, which were denied, but noted he was asking for the minimum, as where the other requests were for more than ten (10) feet.

Attorney Gougelman gave background on the property and previous requests citing Thompson V. Duvall County.

Mr. Dullaghan moved to grant the variance request as an unnecessary hardship and allow for the setback to be twenty (20) feet instead of twenty-five (25) feet from the property line on the side-abutting street west of the property line. Mr. Bates seconded. Motion carried unanimously.

4. ADJOURNMENT
The meeting was adjourned at 6:28 PM.
