MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON MAY 11, 2011

1. CALL TO ORDER AT 5:30 PM

Chairman Wright called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES

Minutes 11-05, March 23, 2011
Vice-Chairman Justice moved to approve the minutes as written. Ms. Lewandowski seconded. Motion carried unanimously.

3. VARIANCE REQUEST

A. A variance is being filed by Amibka Palaniyandi regarding Lots 9, 10 and 11, Blk. 99, 1325 South Miramar Avenue, Indialantic, Florida 32903. A variance is being requested to Code Section 6-30 – Indialantic Coastal Construction Code – building east of the coastal construction line (continued from the April 27, 2011 meeting).

Bob Scales, 111 Cleveland Avenue, Cocoa Beach, Florida, representing the owner of the property noted the property met all criteria in Town Code. The variance being requested is for building 231.97 feet east of the coastal construction line.

Ms. Lewandowski noted there was no letter from the professional engineer and would like to have a letter from the professional engineer before they proceed.

Ms. Lewandowski moved to continue the meeting for Amibka Palaniyandi until May 16, 2011 at 5:30 PM. Vice-Chairman Justice seconded. Motion carried unanimously.

B. A variance is being filed by Dena J. Pascazi regarding Lots 3, 4, 5 and 29 excluding East 50 FT., Blk 50, 501 North Riverside Drive, Indialantic, Florida 32903. A variance is being requested to Code Section 17-121 (5)(b) – Lot dimensions – width at the building line, one hundred (100) feet (for parcels A and B); Code Section 17-82 (1) – Lots of record in residence district – Minimum size (for Parcels A and B; Code Section 17-82 (3) – Lots of record in residence district – Access (for Parcel A); Code Section 17-83 – Reduction in lot (for Parcel B).

Ms. Pascazi advised she is looking to subdivide her property.

Town Manager Chinault noted Ms. Pascazi would need all the variances requested in order to proceed further. A 31’ variance is being requested on the north side and a 19’ variance is requested for the south side. The house lot would be left non-conforming at 80’x175’. The non-resident side of the property would be ~12,000 sq. ft. and the resident side ~14,000 sq. ft. Town Manager Chinault also noted the variance would stay with the property.

Kent Broome, 510 North Riverside Drive, spoke in favor of the application.

The following residents submitted letters in favor of the application:

Priya Bundy, 445 First Avenue
Joe and Sue McAllister

Ms. Lewandowski noted this application was neither a hardship nor a practical difficulty but was for economic gain.

Ms. Lewandowski moved to deny the application for all six variance requests presented by Ms. Pascazi. Vice-Chairman Justice seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting was adjourned at 6:17 PM.
