MINUTES OF A ZONING AND PLANNING BOARD MEETING HELD IN THE INDIALANTIC TOWN HALL ON MARCH 22, 2011

1. CALL TO ORDER AT 5:30 PM
Chairman MacNeill called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES
A. Minutes 11-05, February 22, 2011

Ms. Hay moved to approve the minutes as written. Vice-Chairperson Kleving seconded. Motion carried unanimously.

3. APPLICATIONS
A. Site Plan modification for Baroos Beachside Bar, 810 North Miramar Avenue, Indialantic, Florida – wooden deck addition

Town Manager Chinault noted the deck was in compliance and that two handi-capped parking spaces would need to be put in front of the hardware store at the shopping center.

Mr. Stokes noted it would have to become a restaurant to get the outdoor café status and no certificate of occupancy would be issued if they did not receive restaurant status.

The following individuals spoke in favor of the project:
Neil Evans, 470 Seabreeze Avenue, Indialantic, Florida

Mr. Bertel moved to approve the site plan modification to include conditions set forth in the March 17, 2011 memo as follows:
Ø The applicant shall comply with all requirements of the Town’s consulting engineer
Ø Prior to issuance of the building permit for the outdoor café there will be a visual assurance made by the Town’s Building Official that Baroos operates as an enclosed restaurant with a seating diagram and menu being provided.
Ø The number of outdoor seats is regulated by the Town Code, which requires a maximum of one seat for each fifteen square feet (one thousand square feet divided by fifteen = sixty-six seats at maximum). However, this allowance is restricted in that the number of outdoor seats cannot exceed fifty percent of the number of restaurant seats inside. The Building Official will need to enforce this restriction at the building permit and certificate of occupancy stages.
Vice-Chairperson Kleving, seconded. Motion carried unanimously

4. REPORTS AND DISCUSSIONS
A. Ordinance 11-08 – amending Section 17-100 – Private driveways in the residential district, to find consistent with the Town’s adopted comprehensive Plan, and in particular, Policy 1.1, Objective 1, Future Land Use Element of the Plan.

Town Manager Chinault gave background information to the Board regarding the ordinance.

Mr. Sullivan moved to find Ordinance 11-08 consistent with the Town’s adopted comprehensive Plan, and in particular, Policy 1.1, Objective 1, Future Land Use Element of the Plan. Ms. Hay seconded. Motion passed with Chairperson MacNeill, Vice-Chairperson Kleving, Mr. Betel, Ms. Hay, Mr. Sullivan and Ms. Hoffman voting “aye” and Mr. McCabe voting “nay”

5. REPORT FROM BUILDING OFFICIAL
A. Reports included in packets as informational pages to the Board.

6. ADJOURNMENT
Mr. McCabe moved to adjourn the meeting at 6:20 pm. Mr. Bertel seconded. Motion carried unanimously.
