MINUTES OF A REGULAR TOWN COUNCIL MEETING HELD IN THE INDIALANTIC TOWN HALL ON JUNE 21, 2011

PRESENT: Hon. Dave Berkman, Mayor
Hon. Loren Goldfarb, Deputy Mayor
Hon. Stuart Glass, Councilman
Hon. Randy Greer, Councilman
Paul Gougelman, Town Attorney
Christopher W. Chinault, Town Manager

I. CALL TO ORDER AT 7:00 PM

Mayor Berkman called the meeting order at 7:00 pm.

II. PLEDGE OF ALLEGIANCE

III. PUBLIC

A. Presentation to the Indialantic Fire Department – Garrett Lamp, St. Baldrick’s Foundation

Garrett Lamp, St. Baldrick’s Childhood Cancer Research, thanked the Fire Department for its fund raising efforts at the March event noting that Indialantic raised $17,000.00, which was the highest per capita collection.

IV. PUBLIC ANNOUNCEMENTS

The Town Clerk read the following announcements:

A. There are currently openings, including reappointments, on the Civil Service Board, Code Enforcement Board, General Employees’ Pension Board, Police/Fire Pension Board and Parks, Recreation and Beautification Committee

A. There will be openings, including reappointments, on the Code Enforcement Board and Parks, Recreation and Beautification Committee in July

B. Town Hall will be closed Monday, July 4, 2011

V. CONSENT AGENDA

A. Minutes No. 11-10 – Regular Meeting – May 17, 2011

B. Authorization to close Crossover #10

C. Approval of Budget Adjustment #4 – FY-11

D. Approve setting the date for the 60th Anniversary celebration for March 9, 10 and 11, 2012 and sanction it as a special event

E. Approval of Mowing and Landscape Maintenance bid award to the low bidder – Greener Pastures Turf, Corp.

F. Approval of contract with Hoyman Dobson for audit services for FY 2011, 2012 and 2013 at an annual cost of $18,500

G. Approval of allocation of Edward C. Byrne Memorial Justice Assistance grant funds in the amount of $209,410 to support the County’s prisoner transport program and direct the Mayor to sign a letter conveying Council’s determination

Mayor Berkman moved to approve items A, D, F and G. Deputy Mayor Goldfarb seconded. Motion carried unanimously.

B. Authorization to close Crossover #10

Town Manager Chinault advised that he is requesting that Crossover #10 be closed because it is unsafe.

Councilman Glass moved to approve Item B. Deputy Mayor Goldfarb seconded. Motion carried with Deputy Mayor Goldfarb, Councilman Glass and Councilman Greer voting “aye” and Mayor Berkman voting “nay” because he preferred that it be repaired.

C. Approval of Budget Adjustment #4 – FY 11

Town Manager Chinault explained that the adjustments are being made based on revised estimated revenues and expenses.

Deputy Mayor Goldfarb moved to approve Item C. Mayor Berkman seconded. Motion carried unanimously.

E. Approval of Mowing and Landscape Maintenance bid award to the low bidder – Greener Pastures Turf, Corp.

Council noted the differences in the mowing bids.

Deputy Mayor Goldfarb moved to approve Item E. Mayor Berkman seconded. Motion carried unanimously.

VI. APPOINTMENTS

A. Civil Service Board – 2 openings. Bernie Gott would like to be reappointed

Mayor Goldfarb moved to reappoint Mr. Gott. Deputy Mayor Goldfarb seconded. Motion carried unanimously.

B. Police/Fire Pension Board – 1 opening. Mike Casey would like to be reappointed

Mayor Berkman moved to reappoint Sgt. Casey. Councilman Glass seconded. Motion carried unanimously.

VII. ORDINANCES AND RESOLUTIONS

A. Ordinance 11-09 – Amending Chapt. 5.5 creating Article V – Attractive Nuisance Condition

1. Second reading – by title only

The Town Clerk read the ordinance by title only.

2. Public hearing and adoption

There were no public comments.

Deputy Mayor Goldfarb moved to adopt Ordinance 11-09. Councilman Glass seconded. Motion carried unanimously.

B. Ordinance 11-12 – Amending Chapt. 5.5 relating to landscaping

1. First reading – by title only

The Town Clerk read the ordinance by title only.

2. Public hearing and adoption on first reading

Town Manager Chinault advised that the Ordinance is being revised and will be on the July agenda.

C. Ordinance 11-13 – Amending Chapt. 17 relating to variances

1. First reading – by title only

The Town Clerk read the ordinance by title only.

2. Public hearing and adoption on first reading

Town Manager Chinault gave background information noting that the ordinance provides guidance to the Board of Adjustment. The Board of Adjustment has reviewed the ordinance and is in support of its adoption.

Deputy Mayor Goldfarb moved to approve Ordinance 11-13. Councilman Glass seconded. Motion carried unanimously.

D. Ordinance 11-14 – Amending Chapt. 15 relating to handicap parking

1. First reading – by title only

The Town Clerk read the ordinance by title only.

2. Public hearing and adoption on first reading

Town Manager Chinault gave background information noting that Attorney Gougelman recommended the changes to clean up the current code.

Councilman Glass moved to approve Ordinance 11-14. Councilman Greer seconded. Motion carried unanimously.

E. Ordinance 11-15 – Amending Chapt. 2 relating to the Police/Fire Pension Fund

1. First reading – by title only

The Town Clerk read the ordinance by title only.

2. Public hearing and adoption on first reading

Town Manager Chinault advised that the language was written by the Police/Fire Pension Board attorney to comply with the IRS regulations.

Councilman Glass advised the General Employees Pension Board should be notified of these changes as well.

Deputy Mayor Goldfarb moved to approve Ordinance 11-15. Councilman Greer seconded. Motion carried unanimously.

VIII. UNFINISHED BUSINESS

A. Acceptance of the report in the form of the workshop from Councilmember Greer regarding landscaping

Mayor Berkman moved to accept the report from Councilman Greer. Deputy Mayor Goldfarb seconded. Motion carried unanimously.

IX. NEW BUSINESS

A. Discussion and possible action regarding a proposal from Clark Sales Display, Inc. to provide holiday decorations for 2011, 2012 and 2013 at an annual cost of $3,920 (continued from the May 17, 2011 meeting)

Town Manager Chinault gave background.

Deputy Mayor Goldfarb moved to approve the proposal from Clark Sales Display, Inc. Councilman Greer seconded.

The Town discussed this option compared to the Town providing the decorations.

The following gave input:
Jenny Heptig, 240 Ninth Terrace
Vince Benevente, 427 Oakland Avenue
Nancee Hay, 136 Tenth Avenue

Motion passed with Mayor Berkman, Councilman Glass and Councilman Greer voting “aye” and Deputy Mayor Goldfarb voting “nay.”

B. Discussion and possible action regarding proceeding with a Coastal Partnership Initiative grant for three kiosks

Town Manager Chinault gave background information and recommended that the Town not proceed with the grant. The grant was initiated by the Town Centre Committee, which has now been dissolved.

Mayor Berkman moved to approve proceeding with the grant. Councilman Glass seconded for discussion.

The following gave input:

Jenny Heptig, 240 Ninth Terrace

The motion to proceed with the grant was defeated unanimously.

XI. REPORTS

A. Mayor Berkman had no report.

B. Deputy Mayor Goldfarb had no report

C. Councilmember Campbell was not present

E. Councilmember Greer received clarification that the repairs to the outfall at Watson are completed and that as-builts are being prepared.

The meeting adjourned at 7:55 pm.
