MINUTES OF A BOARD OF ADJUSTMENT MEETING HELD IN THE INDIALANTIC TOWN HALL ON FEBRUARY 21, 2011

1. CALL TO ORDER AT 5:30 PM

Vice-Chairperson Justice called the meeting to order at 5:30 PM.

2. APPROVAL OF PRIOR MEETING MINUTES

A. Minutes 11-02, January 6, 2011
Ms. Lewandowski moved to approve the Minutes 11-02, January 6, 2011. Mr. Dullaghan seconded. Motion carried unanimously.

B. Minutes 11-03, January 27, 2011
Ms. Lewandowski moved to approve the Minutes 11-03, January 27, 2011. Mr. Dullaghan seconded. Motion carried unanimously.

3. VARIANCE REQUEST

A. A variance is being filed by Laurie Behr, owner of Java Surf, regarding Lot 37, Blk. 12, 2 Wavecrest Avenue, Indialantic, FL 32903. A variance is being requested to Code Section 17-106.4(6)(e)1 – Detached Signs

Ms. Lewandowski disclosed that she had spoken with the applicant several months prior regarding signage for the business.

Laurie Behr, owner of Java Surf noted the customers were letting her know they didn’t know she was there due to the location of the business not being visible from the beach or Wavecrest Avenue. Ms. Behr was permitted a banner for seven days and business has increased this past weekend.

The following individuals spoke in favor of the variance:
Jill Hoffman, 125 Michigan Avenue
Charlda Sizemore, 50 Eleventh Avenue

Ms. Lewandowski moved to approve the variance request as a practical difficulty for Java Surf due to lack of sign exposure for the business with the following conditions: the sign shall not exceed 32 square feet, the sign shall be erected on the existing poles below the existing 32 square foot Bizzarro’s sign, the bottom edge of either sign shall have at least a 7 foot clearance from the ground, the sign may be two-sided and the sign shall comply with all other applicable sections of the Town signage regulations. Mr. Dullaghan seconded. Motion carried unanimously.

4. ADJOURNMENT

The meeting was adjourned at 5:58 PM.
