Town Manager’s Report
  1. Pedestrian Signs:  FDOT was requested to improve the pedestrian crossing signs on US-192/SR-500.  Chris Cairns noted that FDOT will look at the signs on SR-A1A and US-192.  (4/21/09)
  2. Melbourne Causeway:  FDOT has included in the Tentative Five-Year Transportation Plan replacing the easternmost relief bridge (bridge number 700037) and the parallel pair of relief bridges (bridge numbers 700173 & 700175), which are east of the Ernest Kouwen-Hoven Bridge on US-192.  The plan includes monies in FY-06 for design and monies in FY-10 ($8.223 million) for construction.  For the tentative FDOT Five-Year Plan the construction cost has been projected at $15.7 million.  The Brevard County Causeway Vulnerability Study will impact this project but it appears that the Indian River Lagoon North Restoration Feasibility Study will not.  A temporary bridge will be constructed south of the existing bridge, which will protrude about 45 feet south of US-192 along Douglas Park.  Staff has requested that a separated 10-foot bike path be constructed on the bridges for traffic moving in both directions and four-foot bike lanes along the outer lanes of the new bridges.  It is expected that the current pedestrian and bicycle traffic thruways will be maintained during construction.  Preliminary plans provided by FDOT’s consultant on 2/28/07 reflect six-foot wide temporary bike/pedestrian bridges along the south side of the causeway south of the westernmost relief bridge and the easternmost relief bridge.  The project proposes to have a five foot wide protected sidewalk along the north side of the westernmost relief bridge and an eight foot wide protected sidewalk along the south side of the easternmost relief bridge.  A public meeting was held 6/11/07 at Eastminster Presbyterian Church from 5 to 7 pm.  The FDOT Proposed Five-Year Plan for FY-10 through FY-14 reflects no change in year for replacing these three relief bridges; however, the amount included in the budget is $15.875 million.  Bids are due August, 2009.  Firms interested in participating in the design/build process are contacting the Town with regard to project concerns.  (4/21/09)
  3. Beach Re-nourishment Project: The County is planning to have sand installed on the beach between November, 2009, and May, 2010, which should widen the beach consistent with the width enjoyed after the first beach re-nourishment effort in 2003.  Prior to the 2003 effort the Town had to close dune crossovers due to sand being washed away from the bottom of the beach side of the crossover steps.  While the dredge will work from the waterside, staging areas will be the dune cut in the vicinity of Watson Drive, east of SR-A1A, and state land, east of SR-A1A, across from Ocean Terrace.  (06/16/09)
  4. Sea Turtle Educational/Informational Signs: The Sea Turtle Preservation Society is working on developing an educational/informational series of signs that can be situated in Nance Park. Staff will also look at any opportunity to utilize the signs in Wavecrest Park Extended.    (03/17/09)
  5. Comprehensive Plan/Evaluation & Appraisal Report (EAR): A workshop for the public and Zoning & Planning Board to provide input for development of the EAR to meet State requirements was held on February 27, 2007.  On August 28, 2007, the Zoning & Planning Board authorized transmitting the EAR to DCA for informal review and to Council, which adopted the EAR on November 20, 2007.  DCA has found the EAR sufficient.  The Town has 18 months from 11/20/07 (i.e. May 20, 2009) to adopt the EAR based amendments to the Comprehensive Plan.  Council agreed on November 18, 2008, to have the planning consultant prepare the EAR based amendments.  The consultant intended to present the EAR based amendments to Z & P for the April 28, 2009, meeting; however, there was not a quorum present so the plan was considered and approved by the Zoning & Planning Board on May 26, 2009.  Council will consider the EAR based amendments on June 16, 2009.  (06/16/09)
  6. Mitigation Grant:  An application was sent to the Florida Department of Community Affairs on May 2, 2005, for $53,000 in FEMA monies with $17,667 being the local share, for shutters and a generator for Town Hall.  DCA noted that the emergency generator was ineligible for funding; however, approved $17,042 in non-local funds requiring $5,681 in local match for shutters.  An executed copy of the agreement was received by the Town on May 25, 2007.  Staff costed out the improvements and requested that the State allow the Town to install armor shield fabric roll-up shutters at the sets of French doors and install the fabric instead of shutters over the front windows.  An updated list of costs was provided to DEM.  Amendment #1 to the Agreement was provided to the Town, signed, and returned to DEM on September 2, 2008.  The executed agreement was received on October 24, 2008.  The shutters and solid door for the southwest corner of Town Hall have been installed.  Final close-out documents have been submitted, a final inspection was held on April 8 with additional information being sent to DEM on 4/10/09.  (4/21/09)
  7. SR-A1A Outfall @ Watson Drive: The County is attempting to decrease the amount of SR-A1A street right-of-way water than runs onto the beach.  They plan to place permeable pipes parallel to the existing pipe that runs along Watson Drive from SR-A1A to the beach.  The improvement is needed to ensure that the Town will be eligible to receive beach sand in the future.  (11/18/08)
  8. Dispatch Services: The Town currently dispatches police and fire/rescue services to the residents.  The County has undertaken a study to determine if it is feasible to have a unified dispatch center with all dispatch services coming from that center.  Town staff has opposed this unification due to the expectation that new dispatch personnel will be less familiar with the Town and Town residents.  Additionally, the centralization will result in there not being a person in Town Hall at all times.  It is possible that a partial centralization will occur with Melbourne and Palm Bay joining in a united dispatch service and the Sheriff’s Department and County Fire/Rescue joining in a united dispatch service.  (06/16/09)
  9. Artificial Surfing Reef: The County conducted a feasibility study regarding the construction of an artificial surfing reef.  The following three sites were considered:  south of the Cocoa Beach pier, east of Lori Wilson Park, and east of Sunrise Park.  The study does not appear to project that, based on cost, the construction of such a reef made of geotextile with sand filled containers (design and permitting cost of $460,000 and construction cost of $5.65 million) and with a useful life of 25 years is feasible.  The intent of the study was to determine if there could be a benefit to surf conditions and a reduction in beach erosion.  (11/18/08)
  10. Fire Station Hazard Mitigation Grant: A $35,000 grant application was submitted for FEMA Hazard Mitigation money available to the County from TS Fay to harden the station bay doors and shutter the windows ($26,250 FEMA/$8,750 local).  (4/21/09)
  11. Turtle lights: A grant application was submitted to replace the industrial type lights along the east side of Wavecrest Avenue south of Access #8 with bollard lights.  The tag monies application was denied.  A full application was submitted to the National Fish & Wildlife Foundation on June 10, 2008.  NFWF notified the Town that the grant request was approved which was followed by a grant agreement being received on October 13, 2008, which was signed and returned to NFWF.  The executed agreement was received for the $98,660 project on October 27, 2008.   FDEP issued a field permit for the project.  The vendor for the lights indicated a price increase that places the costs above the grant amount.  Staff has communicated with NFWF to determine if additional funds are available while also looking for alternative vendors.  NFWF has agreed to extend the grant performance period.  An alternative bollard light was located and sixty-six lights have been installed.  The conduit, light bases, directional bore, and hand-hold have also been installed.  Public Works personnel installed sod in the disturbed area.  FPL has removed the wires, lights, brackets, and poles.  Staff will begin the grant close out process.  (06/16/09)
  12. No Fishing: A letter was sent to FDOT District 5 requesting the installation of signs at both end of the south side of Bridge Number 700037 (i.e. easternmost relief bridge) prohibiting fishing from the forty-two inch wide walkway.  No fishing signs were installed at the east and west ends of the bridge on both the north and south sides.  (06/16/09)
  13. Parking: The Knights of Columbus have secured approval from Gina Realty, the owner of Lots 12 through 15, Block 65 (bounded by SR-A1A to the east, 2nd Avenue to the north and 3rd Avenue to the south), to utilize the property as a parking lot during the Art and Craft festivals.  This is being considered as a fund-raising opportunity for the K of C.  They currently use the property to sell trees in November/December each year.  Council previously approved the use of the property for the selling of Christmas trees.  The Knights of Columbus will present a formal request shortly that will go to Council for consideration.  (06/16/09)
  14. Web Site:  The vendor provided on February 17, 2009, an agreement to provide services toward a new web site for the Town as well as to provide hosting services.  The agreement is being restructured and technical information is being secured.  The Town Manager and Clerk met with the consultant on April 29th and revisions were submitted on May 11, 2009 for consideration.  A revised document was received on May 27, 2009 and sent to the Town Attorney on June 3, 2009.  (06/16/09)
  15. Solar/ArcStar: Three documents were provided to the Town on September 2, 2008, with one of them calling for an exclusive easement to be provided to ArcStar.  Mr. Draa was advised that consideration of these documents would be a much longer process in that the Town Code (i.e. Section 11-5.5) requires voter determination for Council to consider giving away any interest in Town property.  (9/16/08)  Some substitute documents have been provided.  (10/21/08)
  16. Movie: The Parks & Recreation Committee is sponsoring a movie, “An American Tail” for June 26, 2009, in the Council Chamber.  (05/19/09)
  17. TS Fay: The State has notified the Town that it is not recommending funding the full amount for the replacement of the failed storm drain pipe under S. Ramona Avenue immediately north of Orlando Boulevard.  The State prefers to allow for the payment of a patch.  BSE has prepared a response that was included in the Town’s appeal to DEM on April 21st.  (05/19/09)
  18. Recycling: Harris Sanitation has ordered the auto carts to be used for the Town’s recycling effort.  The intent is to have the carts delivered prior to September for implementation.  (06/16/09)
  19. Stimulus Projects: The Florida League of Cities conducted a survey of member jurisdictions for the National League of Cities requesting information regarding projects that can start quickly.  Based on the request, a list of projects that can commence quickly was submitted—i.e. construction of 800 linear feet of pipe to connect 6th Avenue to 9th Avenue along S. Riverside Drive for storm water drainage purposes at an estimated cost of $100,000; replacing 40,000 linear feet of existing storm water drainage pipe at an estimated cost of $3.6 million; and South Reach Beach Renourishment (requested to be included in the list by Brevard County) at an estimated cost of $15 million.  The Orlando Boulevard portion of the existing storm water drainage pipe project, which comprises about 20 to 25 percent of the pipe system, was explored as a possible water quality improvement project should grant money be available for water quality improvements.  The projected cost is $2.13 million factoring in certain Federal requirements.   It appears that water quality money is being channeled into loan efforts.  (03/17/09)
  20. Miramar Condominium Project: The site plan for the Miramar Condominium project along the east side of SR-A1A immediately south of the Dolphin Club was previously approved by the Zoning & Planning Board for a two building project consisting of twenty-four units.  The current extension granted in December, 2008, was set to expire July 22, 2009; however, in the 2009 session of the legislature the State passed SB-360 which affords approved development projects a two-year extension of the development permit.  Miramar Partners, LLC has requested the two-year extension and it was granted on June 9, 2009.  (06/16/09)
  21. Nance Park Restrooms: Touch-up painting was performed on the east side of the restroom facility and the existing lights in the breezeway were replaced with more turtle friendly light fixtures.  Additionally, Public Works personnel will be painting the interior of both restrooms over the next few weeks.  (06/16/09)
  22. Fire: Saturday night, June 6, 2009, a fire was reported in one of the units in the eight-unit apartment building at the southeast corner of S. Shannon Avenue and Tampa Avenue.  Town fire personnel responded with units from Melbourne, Melbourne Beach and the County.  No injuries were reported.  Major damage, reportedly, was sustained by one unit with significant damage to the unit below it.  The other six units suffered only some smoke damage.  (06/16/09)
